Terms of Service

Please read these Terms of Service ("Terms", "Agreement") carefully before using the GetPaid Faster mobile application ("App", "Service") operated by us ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, accessing, or using GetPaid Faster, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

These Terms constitute a legally binding agreement between you and us. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this Agreement.

2. Description of Service

GetPaid Faster is an invoice management and reminder application designed to help freelancers, small business owners, and professionals:

• Create and manage invoices with client information, amounts, and due dates
• Track payment status and due dates
• Receive automated notifications about upcoming, due, and overdue invoices
• Access pre-written reminder message templates
• Export invoice data to CSV and PDF formats (Pro feature)
• Create custom reminder templates (Pro feature)
• Receive weekly summary notifications (Pro feature)

3. User Accounts and Data

3.1 No Account Required

GetPaid Faster does not require user account creation, registration, or login. The App operates entirely on your device.

3.2 Your Responsibility for Data

You are solely responsible for:

• Maintaining the security and confidentiality of your device
• All invoice data you enter into the App
• The accuracy of information you provide
• Backing up your invoice data
• Any use of the App from your device

3.3 Data Loss

We are not liable for any loss, corruption, or deletion of data due to:

• Device loss, theft, or damage
• App uninstallation or deletion
• Device malfunction or software errors
• iOS updates or device resets
• Any other circumstances beyond our control

We strongly recommend enabling iCloud backup and regularly exporting your data (Pro feature).

4. Subscription Terms

4.1 Free Version

The free version of GetPaid Faster provides basic invoice management features with the following limitations:

• Limited number of invoices
• Access to pre-written reminder templates (view only)
• Basic notifications (Before Due, Due Today, Overdue)

4.2 Pro Subscription Features

Pro subscription unlocks the following premium features:

• Unlimited Invoices: Create and track unlimited invoices
• Custom Reminder Templates: Create, edit, and save personalized message templates
• CSV Export: Export all invoice data to CSV format
• PDF Export: Generate professional PDF reports of your invoices
• Weekly Summary: Receive Monday morning notifications with outstanding invoice summaries
• Priority Support: Faster response to support inquiries

4.3 Subscription Pricing

GetPaid Faster Pro is available through the following subscription plans:

• Monthly Subscription: $4.99 per month (USD)
• Yearly Subscription: $39.99 per year (USD) - Save 17%

Prices may vary by region and are subject to applicable taxes. Prices are displayed in your local currency in the App Store.

4.5 Free Trial

New subscribers may be eligible for a free trial period. After the free trial period ends, you will be automatically charged the subscription fee unless you cancel before the trial ends. Trial eligibility is determined by Apple and may be limited to one trial per Apple ID.

4.6 Managing Your Subscription

You can manage and cancel your subscription at any time through your Apple App Store account settings:

1. Open the Settings app on your iOS device
2. Tap your name at the top of the screen
3. Tap Subscriptions
4. Select GetPaid Faster
5. Tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the end of your paid period.

4.7 Refunds

All subscription purchases are processed through Apple's App Store. We do not have access to your payment information and cannot process refunds directly.

Refund requests must be submitted to Apple through:

• Apple's website: reportaproblem.apple.com
• Apple Support app on your device
• Contacting Apple Support directly

Refunds are subject to Apple's refund policies and are granted at Apple's sole discretion.

5. Acceptable Use

You agree to use GetPaid Faster only for lawful purposes and in accordance with these Terms. You may not:

• Use the App for any illegal activities or to facilitate illegal activities
• Violate any local, state, national, or international law or regulation
• Attempt to reverse engineer, decompile, disassemble, or modify the App
• Use the App to harass, threaten, or intimidate others
• Share your Pro subscription access with others or attempt to transfer your subscription
• Attempt to circumvent payment mechanisms, subscription features, or usage limitations
• Use the App in any way that could damage, disable, or impair the Service
• Introduce viruses, malware, or other malicious code
• Collect or harvest any information from the App or other users
• Use automated systems or software to extract data from the App

6. Intellectual Property Rights

6.1 Our Rights

The App, including all content, features, functionality, source code, design, graphics, user interface, and the selection and arrangement thereof, are owned by us and are protected by:

• United States and international copyright laws
• Trademark laws
• Patent laws
• Other intellectual property rights and unfair competition laws

6.2 Your Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for your personal or internal business purposes

This license does not include the right to:

• Resell or make commercial use of the App
• Modify or make derivative works based on the App
• Download or copy content except as expressly permitted
• Use data mining, robots, or similar data gathering tools

6.3 Trademarks

"GetPaid Faster" and our logo are trademarks or registered trademarks. You may not use these marks without our prior written permission.

7. Disclaimer of Warranties

We disclaim all warranties, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• That the App will be uninterrupted, secure, or error-free
• That defects will be corrected
• That the App is free of viruses or other harmful components

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, revenue, data, or business opportunities
• We shall not be liable for any personal injury or property damage
• Our total liability shall not exceed the amount you paid for the subscription in the 12 months preceding the claim, or $100 USD, whichever is less

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

9. Professional Advice Disclaimer

The App provides tools for invoice management and reminders only. We do not provide:

• Financial advice or planning services
• Legal advice or services
• Tax advice or preparation services
• Accounting or bookkeeping services
• Business consulting or strategy advice
• Debt collection services

You should consult with qualified professionals regarding your specific business, financial, legal, and tax matters.

10. Notifications

The notification features of GetPaid Faster are provided for convenience only:

• You remain solely responsible for tracking your own invoices and payment deadlines
• We are not liable if notifications fail to deliver, are delayed, or are not received
• Notification timing may vary based on device settings, network conditions, and iOS system resources
• Notifications may be affected by Do Not Disturb mode, notification settings, or other device configurations
• We do not guarantee that notifications will be delivered at specific times

11. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the App
• Your use of the reminder templates or messages

12. Changes to the Service

We reserve the right to:

• Modify or discontinue the App or any features at any time, with or without notice
• Change subscription pricing with 30 days' notice to existing subscribers
• Update, change, or remove content from the App
• Impose limits on certain features or restrict access to parts of the App

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We may modify these Terms at any time by posting the updated Terms in the App. Changes will be effective when posted, unless otherwise specified.

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

Material changes will be notified through:

• In-app notification
• Email (if you have provided an email address)
• Updated "Last Updated" date at the top of this page

14. Termination

14.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. To cancel your subscription, follow the instructions in Section 4.6.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons
• At our sole discretion

14.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• You will lose access to Pro features if applicable
• We are not obligated to provide refunds for unused subscription periods
• Sections of these Terms that by their nature should survive termination will survive

15. Apple App Store

These additional terms apply if you download the App from the Apple App Store:

• Your use of the App is also subject to Apple's App Store Terms of Service
• This Agreement is between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support or maintenance for the App
• Apple is not responsible for any product warranty claims
• Apple is not responsible for addressing any claims by you or third parties relating to the App
• Apple is a third-party beneficiary of this Agreement and has the right to enforce this Agreement against you

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

16.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through:

1. Informal Resolution: We encourage you to contact us first to seek informal resolution
2. Binding Arbitration: If informal resolution is unsuccessful, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's rules
3. Class Action Waiver: You agree that disputes will be resolved on an individual basis and waive any right to participate in class actions

16.3 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice or consent.
